Canty v Ireland & ors: It seems to me that the Oireachtas is entitled under Article 34.4.3º of the Constitution to adopt a policy with regard to finality in landlord and tenant matters as between contracting parties. I am of the view that this was the intention behind the establishment of the 2004 Act, and certainly the inclusion of subs. (4) in s. 123. I do not read that restriction as exceeding what is authorised by Article 34.4.3º of the Constitution. There is in my view no ambiguity in the language of the subsection: the only meaning of it is that which I have endeavoured to describe. Consequently I cannot accept Mr. Canty's submission that he has made out an arguable case for the interpretation as suggested by him and secondly, given the statutory framework against which the restriction must be judged, it cannot in my opinion be said to be incompatible with the provisions of Article 34.4.3º of the Constitution."?

I’ve seen corrupion, major corruption over the years, between Solicitors, Gardai, Judges, witnesses etc. The Garda Ombudsman issued a report on Garda corruption in Ireland. Basically they said that they couldn’t find any significant findings to actually say that the majority of Gardai were corrupt. It’s a joke. The Garda Ombudsman are now trying to eliminate smaller complaints, i.e. complaints relating to searches, arrests, warrants etc. They say that the majority of complaints relate to these trivial matters. Personally, I don’t see any real difference between the original and incompetent Garda Complaints Board and the Garda Ombudsman.?

ENCOURAGECHANGE.: William Fry - Publication - Prevention of Corruption Legislation Enhanced: "The legislation’s most significant provisions relate to “whistleblowers”. Protection for whistleblowers was introduced in the UK by the Public Interest Disclosure Act 1998, but until now there has been no similar legislative protection in Ireland for whistleblowers. Under the new Act, where a person believes that a corruption offence has been committed and he reports that opinion, he will be protected against actions for damages and other relief unless he knew that, or was reckless as to whether, his opinion was false or vexatious. Whistleblowers must report their opinion to an appropriate person, the list of whom includes a member of An Garda Síochána, the whistleblower’s employer and any “confidential recipient” appointed by the Garda Commissioner to receive such communications in confidence. Where the whistleblower’s opinion is reported to a confidential recipient, his identity will (with some exceptions) be kept confidential. Employers are also prevented from penalising employees who have reported, or intend to report, corruption offences and the new legislation sets out a redress procedure for such employees."?

Following consultations with the Garda Commissioner, I have sent the report to the Garda Síochána Ombudsman Commission to examine it as a matter of urgency and see whether further action is warranted. That examination is taking place. I repeat to the House the apology I gave last week on behalf of the State for the Garda’s failure in three cases detailed in the report. These failures should not have occurred. It is important to note that the commission’s overall conclusion was that the Garda response to the cases covered by the report had been generally adequate and appropriate. A number of complainants were highly complimentary about the way in which gardaí had dealt with their complaints.?
