Public Inquiry · Standards in Public Office Commission rejects complaint against Minister Quinn: This type of loophole legislation does not appear out of thin air.
It is very carefully drafted by professional civil servants working with the best legal advice and the full approval of the body politic.
Such loose, weak legislation is only one aspect of an all-embracing culture of secrecy, obfuscation, denial and non-cooperation that has created an environment where political and business corruption thrives.?

ENCOURAGECHANGE.: Prosperity on RTE last night

ENCOURAGECHANGE.: Prosperity on RTE last night: "But the basic shape, a marginalised youth with nowhere to go, is that of what was meant to be a breakthrough social-realist drama, first screened by RTÉ in 1971. Brian MacLochlainn's A Week in the Life of Martin Cluxton followed a Dublin kid released from an industrial school and finding that he belongs nowhere in an indifferent city. The two films even share the same political subtext, drawing attention to those left behind by a long economic boom and to the State's carelessness of those who need it most."?

ENCOURAGECHANGE.: Abbey Theatre - Amharclann na Mainistreach: "Vanessa O’Connell will present the character ‘A’ (played by Andrea Irvine), Amanda Coogan ‘B’ (Kate Brennan), and Darren Byrne will interpret Karl Shiels as ‘C’ in this exhilarating production. This style of one-on-one character interpretation is a first at the Abbey Theatre. It represents an exciting development in the sign language interpretation of theatre and performance, allowing the interpreters to be true to the actors onstage as well as to the words of the playwright. Certainly O’Rowe, who has also written screenplays for the hit Irish films Intermission and Boy A, has a unique and vivid manner of storytelling that lends itself perfectly to this format. His gripping tale of singing serial killers, avenging angels and lovesick demons promises to leave audiences clinging to the edge of their seats."?

Investigative Journalism Summer School 2012 – The Story

Investigative Journalism Summer School 2012 – The Story: For the past couple of years I have attended the rather excellent Investigative Journalism Summer School in London run by the CIJ. It’s on again this year on July 6th to July 8th. Knowing that a large amount of Irish journalists subscribe to this blog I would encourage them (and others!) to attend. The cost if you book before May 4 is just £260 for three full days training – a bargain. The first year I was there, there were three journalists from Ireland, including myself. The second year there were five including myself – perhaps this year we can get it do a dozen?OR MAYBE 13?

Publication Detail: The Honest Services Statute: When Federal Righteousness Goes Off The Rails

Publication Detail: The Honest Services Statute: When Federal Righteousness Goes Off The Rails: In recent years, federal prosecutors have been aggressively using the so-called "honest services" statute to accuse local politicians and corporate CEOs of criminal wrongdoing. The U.S. Attorney in Chicago, Patrick Fitzgerald, has garnered much attention, for example, as a result of his effort to crack down on corruption in the Windy City. Scores of federal cases are being brought against local officials around the country. Since no one believes that corruption is desirable, the federal attorneys have been able to deflect scrutiny of their methods by focusing attention on the shady actions of their targets.?

Publication Detail: The Honest Services Statute: When Federal Righteousness Goes Off The Rails: The Supreme Court has granted review in a second honest services fraud case, Weyhrauch v. United States (08-1196). The Court's ruling will resolve a split in the federal circuit courts over whether the honest services law mandates the creation of a federal "common law" which defines the disclosure obligations of state and local government officials. The U.S. Court of Appeals for the Ninth Circuit, following the Seventh and Eleventh Circuits, held in Weyhrauch that disclosure obligations whose breach can be a predicate for honest services violations can be determined by federal common law. The Third and Fifth Circuits, in contrast, have held that courts must look to state or local law, not federal common law, to determine if a breach of a disclosure duty has occurred.?

Shatter's bill changes NOTHING. Seal of the Confessional remains.: Sacerdotal privilege is and was recognised as part of our domestic Constitutional law, ie a “rule of law” as far back as 1945 in a case titled Cook V. Carroll. I am unable, at present, to provide an open source access to it, so you will have to trust me on that particular issue. It’s not controversial anyway. Now, one argument made is that Judgment was given when the special position of the Catholic church was recognised constitutionally and, since it’s removal, the Judgment is no longer of such strength in terms of jurisprudence. However, the Supreme Court has held that that particular, now removed, provision of the Constitution had never any Constitutional effect. PADDYWANTSTOKNOW?

PADDYWANTSTOKNOW?: Several high- profile cases of white-collar crime have been in the news recently. Scandals on Wall Street, in the Irish banking system and amongst organizations, like FÁS, have dominated the front pages of newspapers and the schedules of radio programmes and TV chat shows. So what is it about white-collar crime that makes it so newsworthy in comparison to ordinary crime? Sometimes it is partly the sheer scale of operation, but more often than not it is to do with who is involved. People are completely shocked to hear that an affluent business man was involved in crime. This is also the reason that the populace becomes so irate. Why would one feel happy about paying taxes to drive a politician in a limo between two buildings in an airport? Why should the repoman come and reclaim your house when the bank manager has being embezzling funds for the good of his bulging pocket? In a lecture given to students in Cork, the Master of the High Court Edmund Honohan SC advocated independent regulation of the profession saying that no spinning by the Society could disguise the systemic failure of self-regulation. He said most solicitors must now realise they had been let down, not just by a few rogue negligent solicitors, but by the Law Society itself.

CONNECT TO MY ANGELS

CONNECT TO MY ANGELS: “This is a historic day. Over the past 25 years, successive governments have made commitments to ending the imprisonment of children in Ireland, but this is the first time we have seen a concrete plan and a concrete timeline. Given the current pressures on resources, it is extremely significant that the Minister has received support from the Government to proceed with this project, and it is a powerful statement of the Government’s commitment to the rights of children who come into conflict with the law. The message from the Ryan Report was not just about the past but what needs to change for children in the care of the State today, and the detention of children in prison continues to be one of the most glaring failures in how this State cares for children.”?
