ENCOURAGECHANGE.: February 2012: Chief Justice Susan Denham said. The person authorising a search warrant is required to be able to assess the conflicting interests of the State and the person whose home is to be searched, the judge said. In this case, the detective superintendent was not independent, she added. Article 40.5 of the Constitution expressly provides that one’s home is inviolable and shall not be forcibly entered except in accordance with the law, she said. This meant entry had to be effected “without stooping to methods which ignore the fundamental norms” of the legal order as contained in the Constitution.?

Over a decade later nothing has been done, despite a further report from a committee chaired by then chief justice Ronan Keane and including Mrs Justice Denham. It recommended the setting up of a judicial council on a statutory basis, providing for the representation, education and training of judges as well as a disciplinary mechanism. She has in recent years forced the gardai to reopen a murder file into the infamous Father Niall Molloy due to startling new evidence which she uncovered which pointed to a GUBU case of crazy proportions which involved collusion and/or incompetence by the Gardai, the medical profession, the DPP, the Judiciary and prominent members of Fianna Fail and Fine Gael. This case really is bizarre and O'Doherty has been relentless and dogged in pursuing it.The cold case squad has now wrapped up and sent a file to the DPP who (surprise surprise have stated that no charges are to be brought against anyone). The Molloy family are not surprised and stated that given the behaviour by both bodies over the years they would never properly investigate a matter which would implicate them in gross misconduct. Indo journalist Gemma O'Doherty forced out after Garda Commissioner penalty points doorstep

Indo journalist Gemma O'Doherty forced out after Garda Commissioner penalty points doorstep: 16 year Indo veteran Gemma O'Doherty recently achieved the distinction of being the only Independent journalist to be made redundant compulsorily.
According to this week's Phoenix her sacking was linked to her coverage of the penalty points story earlier in the year.
As the penalty points scandal rumbled on in April it seems that O'Doherty went to Garda Commissioner Callinan's house to check that he had been issued with penalty points that had been cancelled. Callinan's wife confirmed that the address was correct and the Commissioner lived there.
O'Doherty was quickly hauled in by management and given a dressing down, in particular by Stephen Rae, former editor of The Garda Review and recently promoted Editor in Chief of the combined Independent titles.
The Commissioner's penalty points story remained in limbo for a week until TV3 got wind of it and the Indo decided to publish the story. ?
However, O'Doherty some weeks later was offered voluntary redundancy and was then sacked after refusing to take the offer.
Her single minded pursuit of the cover up behind the Father Niall Molloy murder probably didn't endear her to the Garda Siochana either.

In the case of Dublin’s tenement enclaves what is conspicuously missing from the historical scene is credible verbal testimony about daily life patterns by those who were looking out from behind the grim brick walls….By contrast, the avowed purpose of this book is to create an authentic and wholly original chronicle of Dublin tenement community life based on the oral histories of the last surviving dwellers"?

Justice delayed is justice denied - Wikipedia, the free encyclopedia

Justice delayed is justice denied - Wikipedia, the free encyclopedia: ""Justice delayed is justice denied" is a legal maxim meaning that if legal redress is available for a party that has suffered some injury, but is not forthcoming in a timely fashion, it is effectively the same as having no redress at all. This principle is the basis for the right to a speedy trial and similar rights which are meant to expedite the legal system, because it is unfair for the injured party to have to sustain the injury with little hope for resolution. The phrase has become a rallying cry for legal reformers who view courts or governments as acting too slowly in resolving legal issues either because the existing system is too complex or overburdened, or because the issue or party in question lacks political favour."?

Referendum allows us to tackle a legacy of failure - News Debate | Opinion & Discussion |The Irish Times - Tue, Oct 16, 2012: "NOT ALL Irish children have been well served by this country. In fact, so pervasive and awful was the mistreatment of some of our vulnerable citizens, that we have become somewhat immune to mention of it. Nationally we have become so emotionally calloused by the reports of suffering and abuse and neglect that many of us are no longer shocked by revelations that should rock us to our core.
We have become used to horror. We have come to accept as reality that which should be nightmare. We know some Irish children were repeatedly raped by those meant to be caring for them. We know some Irish children were deserted and abandoned by those on whom they depended. We know Irish children were starved and tortured by those closest to them. The thing we sometimes forget is that not all of these horrors are relegated to the distant past."?
