The Department argued that the records were held by the Garda Síochána (which is not subject to the FOI Act) and not held, or under the control of, the Department. The requester argued that the records were under the control of the Department for a number of reasons including the fact that the Department was the contracting authority for the tender and, under the Garda Síochána Act 2005, there was a duty on the Garda Commissioner to provide documents to the Secretary General of the Department"?THE REASONS PROJECT?
